Can we claim childcare expenses if husband works and wife is a student?
Husband works fulltime and also has to leave the country several times a year for months at a time. Wife is a student and sole caregiver most of the year. We have had to hire childcare a lot, can it be claimed against childcare tax deduction since both are not full time employed? Technically I am an able bodied SAHM so was not sure if that would cause us to be excluded. I have had to pay for childcare in order to do my lessons.

- As long as your husband is working and you are considered a full time student the cost of day care is allowable when computing your childcare credit on your tax return.
- For each month that he was employed and you were a full-time student, you can count up to $250 towards your child care expenses. Form 2441 will figure this for you. So if you were a student for 8 months, you can count up to $2,000 of expenses toward the child care credit.
- Yes you can if the wife is a full time student. See page 222 of publication 17.under "Rule for student-spouse"
